Please read these terms and conditions carefully before using our services. By engaging with SP Travel Consultants, you agree to be bound by these terms without modification or exception.
1. Introduction
These Terms and Conditions constitute a legally binding agreement between you and SP Travel Consultants, a travel consultation service provider registered in India. By accessing our website, engaging our services, or otherwise interacting with us, you acknowledge that you have read, understood, and agree to be bound by these Terms.
Our services are provided strictly on the basis of these Terms. No exceptions or modifications will be entertained unless explicitly agreed upon in writing by our authorized representative.
2. Service Description
SP Travel Consultants provides professional travel advisory and consultancy services, including but not limited to itinerary planning, booking assistance, visa guidance, and travel documentation support. Our services are consultative in nature, and we do not guarantee specific outcomes regarding visa approvals, booking confirmations, or travel experiences.
We reserve the absolute right to refuse service to any client at any time without explanation if we determine that providing such services would contravene any applicable laws, regulations, or our company policies.
3. Booking and Payments
All bookings must be confirmed through written communication and are subject to availability. A non-refundable deposit of 50% of the total service fee is required to initiate any booking process. The remaining balance must be paid in full at least 14 days prior to the commencement of services or as specified in your booking confirmation.
Payments must be made through our approved payment methods only. Cash payments will not be accepted without prior written agreement. Any bank charges, transaction fees, or currency conversion costs are the sole responsibility of the client.
4. Cancellations and Refunds
Cancellation requests must be submitted in writing. Our cancellation policy is strictly enforced as follows:
• Cancellations made 30+ days before service commencement: 30% of total payment refunded
• Cancellations made 15-29 days before service commencement: 15% of total payment refunded
• Cancellations made 14 days or less before service commencement: No refund
SP Travel Consultants reserves the unilateral right to cancel services at any time if client behavior contravenes these Terms, if false information has been provided, or if circumstances beyond our control prevent us from delivering our services.
5. Client Responsibilities
You are solely responsible for ensuring the accuracy and completeness of all information provided to us. This includes personal details, travel documentation, and any other information relevant to our services. Any consequences arising from inaccurate or incomplete information provided by the client shall be borne entirely by the client.
Clients must comply with all travel requirements, including but not limited to visa regulations, health requirements, and local laws of the destination countries. SP Travel Consultants provides guidance only and assumes no liability for client non-compliance with any applicable requirements.
6. Liability Limitations
SP Travel Consultants' maximum liability for any claim arising from our services is strictly limited to the amount paid by the client for the specific service in question. Under no circumstances will we be liable for any indirect, incidental, special, consequential, or punitive damages.
We explicitly disclaim all liability for third-party services, including but not limited to airlines, hotels, transportation providers, tour operators, and visa processing authorities. While we endeavor to recommend reputable service providers, we make no warranties regarding their performance or reliability.
7. Force Majeure
SP Travel Consultants shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, civil unrest, terrorism, strikes, epidemics, pandemics, or other public health emergencies.
In the event of a force majeure situation, we reserve the right to suspend, modify, or terminate services without liability. We will make reasonable efforts to provide alternative arrangements where possible, but this is not guaranteed.
8. Intellectual Property
All content provided by SP Travel Consultants, including but not limited to itineraries, travel plans, documents, recommendations, and advice, remains the exclusive intellectual property of SP Travel Consultants. Such content may not be reproduced, distributed, sold, or used for any commercial purpose without our explicit written consent.
9. Privacy and Data Protection
SP Travel Consultants collects and processes client data in accordance with applicable data protection laws. By engaging our services, you consent to the collection, storage, and processing of your personal information for purposes directly related to providing our services.
We implement reasonable security measures to protect client data, but cannot guarantee absolute security. We do not sell client data to third parties but may share information with service providers as necessary to fulfill our contractual obligations.
You have the right to request access to your personal data held by us and to request correction of any inaccuracies.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in the appropriate jurisdiction in India.
Prior to initiating any legal proceedings, clients agree to participate in good faith mediation to resolve any disputes. Mediation shall take place in a location determined by SP Travel Consultants, with costs shared equally between the parties.
11. Amendments to Terms
SP Travel Consultants reserves the right to modify these Terms at any time without prior notice. Updated Terms will be effective immediately upon posting on our website. It is your responsibility to review these Terms periodically.
Your continued use of our services following any modifications to these Terms constitutes your acceptance of such changes. If you do not agree with the revised Terms, your sole remedy is to discontinue using our services.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
